These Terms of Service govern your access to and use of PhotoIns, including our website, APIs, image processing tools, and related services.
By creating an account, purchasing credits, uploading content, or using any feature, you agree to be bound by these Terms.
If you do not agree with these Terms, you must stop using PhotoIns.
1. Scope and acceptance
These Terms form a legally binding agreement between you and PhotoIns for all service usage.
If you use PhotoIns on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.
- These Terms apply to both free and paid users.
- Additional policies, including the Acceptable Use Policy, may apply to certain features and become part of these Terms.
- You are responsible for reviewing the current version of these Terms.
- Continued use after updates indicates acceptance of revised Terms.
2. Eligibility and account responsibilities
You must be legally capable of entering into binding agreements in your jurisdiction.
You are responsible for account credentials, device sessions, and all activity under your account.
- Provide accurate and complete registration information.
- Keep your login credentials secure and confidential.
- Notify us immediately if you suspect unauthorized access.
- Do not share, sell, or lease your account without authorization.
3. Service features and availability
PhotoIns provides image-related processing tools, including AI-powered functions, based on the service features published at the time of use.
Service features may be modified, paused, or discontinued for maintenance, security, legal, or product reasons.
- We do not guarantee uninterrupted or error-free availability.
- Performance may vary by file size, model load, and infrastructure conditions.
- Some features may require login, paid credits, or active membership.
- We may apply usage limits, queue policies, or anti-abuse controls.
4. User content and licenses
You retain ownership of content you upload, subject to rights required for operating the service.
You grant PhotoIns a worldwide, non-exclusive, royalty-free license to host, process, store, and transmit your content strictly for service delivery, security, support, and legal compliance.
You are solely responsible for ensuring that your content and prompts do not violate laws, contracts, or third-party rights.
- Do not upload content you do not have rights to use.
- Do not submit illegal, abusive, infringing, harmful, NSFW, or sexually explicit content.
- Do not use PhotoIns to generate deceptive, unlawful, rights-violating, or sexually explicit outputs.
- We may remove or restrict content that violates policy or law.
5. Prohibited conduct
You may not misuse the service, reverse engineer core systems, bypass controls, content-safety filters, or interfere with normal operation.
You may not use automated or scripted methods to scrape, overload, or abuse the platform beyond allowed interfaces.
Violation may result in suspension, termination, legal action, and removal of content or credits where legally permitted.
- No security testing without prior written authorization.
- No fraudulent payment behavior or chargeback abuse.
- No impersonation or misleading representation of identity.
- No NSFW or sexually explicit content generation, including nude, semi-nude, sexually suggestive, fetish, pornographic content, or any sexual content involving minors.
6. Billing, credits, and refunds
Paid features are provided according to the pricing and credit rules shown at checkout or on the pricing page at the time of purchase.
Unless required by law, credits and purchases are generally non-transferable and non-cashable. Refund handling may require order verification and evidence of technical payment errors.
- You are responsible for taxes or fees required by your jurisdiction.
- Billing providers process payments under their own terms and policies.
- We may correct pricing or billing errors when reasonably necessary.
- Abusive refund behavior may lead to account restrictions.
7. Intellectual property
All platform software, models, interface elements, trademarks, branding, and documentation are owned by PhotoIns or its licensors and are protected by applicable laws.
Except for rights expressly granted in these Terms, no license or ownership transfer is granted to you.
- Do not copy, distribute, or create derivative products from protected platform assets without authorization.
- Do not remove legal notices, trademarks, or attribution from service materials.
- Feedback may be used by PhotoIns without compensation unless prohibited by law.
8. Disclaimer and limitation of liability
PhotoIns is provided on an "as is" and "as available" basis to the maximum extent permitted by law.
To the extent permitted by applicable law, PhotoIns is not liable for indirect, incidental, consequential, or punitive damages arising from service use, interruption, or content outcomes.
- You are responsible for reviewing and validating generated outputs before business-critical use.
- We do not guarantee legal suitability of outputs for your specific jurisdiction or use case.
- Liability caps, where enforceable, are limited to amounts paid by you for the relevant service period.
9. Suspension and termination
We may suspend or terminate access if you violate these Terms, create security risks, or if required by law or provider obligations.
You may stop using the service at any time. Certain obligations (including payment obligations, legal compliance, and IP provisions) survive termination.
- Suspension may be immediate for severe abuse or legal risk.
- Terminated accounts may lose access to stored outputs after retention periods.
- Where practical, we may provide notice and remediation options before termination.
10. Governing law and changes
These Terms are governed by applicable laws determined by conflict-of-law principles and mandatory local regulations where required.
We may revise these Terms from time to time. Updated Terms take effect when published. Continued use after publication indicates acceptance of the revised Terms.
